Welcome to https://acquireup.com (the "Site"). We understand that online privacy is important to users of our Site, especially when conducting business. Therefore, protecting your privacy is very important to us. This statement governs our privacy policies with respect to both users of the Site who visit without transacting business ("Visitors") and who register to transact business on the Site ("Authorized Customers") and make use of the various services offered by AcquireUp (collectively, "Services")

Our goal is to treat the personal information you furnish us with the utmost respect and in accordance with this Privacy Policy. We request that you carefully read this Privacy Policy and our Terms of Use before using the Site. By visiting, viewing or using the Site in any manner you are agreeing to the terms set forth in this Privacy Policy, as well as the Terms of Use for the Site. If you do not agree with our policies and practices, your choice is not to use our Site. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

Children Under the Age of 16

Our Site is not intended for children under 16 years of age. No one under age 16 may provide any Personally Identifiable Information on the Site. We do not knowingly collect PII (defined below) from children under the age of 16. If you are under 16, do not use or provide any information on this Site or through any of its features, register on the Site, make any purchases through the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. Information We Collect

What Personally Identifiable Information is collected?

"Personally Identifiable Information" ("PII") refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, social security number, and credit card information. PII does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.

What organizations are collecting the information?

In addition to our direct collection of information, our third-party service vendors (such as credit card companies, clearinghouses and banks) who may provide such services as credit, insurance, and escrow services may collect this information from our Visitors and Authorized Customers. We do not control how these third parties use such information, but we do ask them to disclose how they use personal information provided to them from Visitors and Authorized Customers. Some of these third parties may be intermediaries that act solely as links in the distribution chain, and do not store, retain, or use the information given to them.

How do we use PII?

We use PII to present our Site and customize its contents for you, to fulfill buying and selling requests on the Site, to provide you with notices or reminders about products, services, events, etc., in any other way we may describe when you provide us the information, and for any other purpose with your consent. We may email Visitors and Authorized Customers about research or purchase and selling opportunities on the Site or information related to the subject matter of the Site. We may also use PII to contact Visitors and Authorized Customers in response to specific inquiries, to provide information, products, or services that you request from us, to provide additional relevant advertisements and offers related to consumer requests, or to notify you about changes to our Site. We may also contact you to carry out our obligations and enforce our rights from any contracts entered into between an Authorized Customer and us, including for billing and collection or for any other purpose with the consent of Authorized Customers.

With whom may Your Information be shared?

PII about Visitors or Authorized Customers may be shared with other Authorized Customers who wish to evaluate potential transactions with other Authorized Customers, with our affiliated agencies, and thirdparty vendors. We may share aggregated information, including, including, but not limited to, the demographics of our Visitors and Authorized Customers, and information that does not identify any individual, with our affiliated agencies and third-party vendors, without restriction. We also offer the opportunity to "opt out" of receiving information or being contacted by us or by any agency acting on our behalf.

Third-Party Use of Your Information

We may share your information with third parties when you explicitly authorize us to share your information.

As stated above, the Site may use third-party service providers to service various aspects of the Site. Their respective privacy policies dictate each third-party service provider's use of your PII. The Site currently uses the following third-party service providers:

How is Personally Identifiable Information stored?

PII collected by AcquireUp is securely stored and is not accessible to third parties or employees of AcquireUp, except for specified uses as indicated above.

Anonymous Data

From time to time, we may use anonymous data, which does not identify you alone, or when combined with data from other parties. This type of anonymous data may be provided to other parties for marketing, advertising, or other business uses. Examples of this anonymous data may include analytics or information collected from cookies.

Retargeting Ads

From time to time, the Site may engage in remarketing efforts with third-party companies, such as Google, Facebook, or Instagram, in order to market the Site. These companies use cookies to serve ads based on a Visitors past visits to the Site. This means; after visiting the Site, you may see an ad for our Services. However, your PII is not used by any remarketing service other than to present you offers from the Site. We use the following third-party service providers for remarketing:

Newsletters

On the Site, you may subscribe to our newsletter, which may be used for advertising purposes. All newsletters sent may contain tracking pixels. The pixel is embedded in emails and allows us to analyze the success of online marketing campaigns. Because of these tracking pixels, we may see if and when you open an email and which links within the email you click. Also, this allows us to adapt the content of future newsletters to the interests of the user. This behavior will not be passed on to third parties.

What choices are available to Visitors regarding collection, use and distribution of the information?

Visitors and Authorized Customers may opt out of receiving unsolicited information from or being contacted by us and/or our third-party vendors and affiliated agencies by responding to emails as instructed, or by contacting us at privacy@acquireup.com.

Are Cookies Used on the Site?

Cookies are used for a variety of reasons; however, we use cookies to obtain certain information about the preferences of our Visitors, such as the number of visits, average time spent, page views and other statistics relating to our Site. Cookies are small pieces of data stored by your internet browser on your computers or other devices hard drive. They cannot be used to collect data, such as your e-mail address or any personal identifying information about you. However, if you decide to register on our Site, we may collect additional information to provide tailored offerings or content to you. In this case, as an Authorized Customer, we use cookies to recognize you on subsequent visits and make your online experience more convenient. In addition, we also use cookies for security purposes to protect our Authorized Customers. For example, if an Authorized Customer is logged on and the Site is unused for more than a set period of time, we will automatically log the Authorized Customer off.

Any user, may, at any time, adjust or set their internet browser settings to notify them when they receive a cookie or to prevent cookies from being sent. Please note, however, that by not accepting cookies, you may limit the functionality we can provide you when you visit our Site.

How does AcquireUp use login information?

AcquireUp uses login information, including, but not limited to, IP addresses, ISPs, and browser types, to analyze trends, administer the Site, track a user's movement and use, and gather broad demographic information.

What partners or service providers have access to PII from Visitors and/or Authorized Customers on the Site?

AcquireUp has entered and will continue to enter partnerships and other affiliations with a number of vendors. Such vendors may have access to certain PII on a need-to-know basis for evaluating Authorized Customers for service eligibility. Our Privacy Policy does not cover their collection or use of this information.

Disclosure of PII

We will disclose PII to comply with a court order or subpoena or a request from a law enforcement agency to release information. We will also disclose PII when reasonably necessary to protect the safety, rights, or property of our Visitors and Authorized Customers.

How does the Site keep PII secure?

All employees of AcquireUp are familiar with our security policy and practices. The PII of our Visitors and Authorized Customers is only accessible to a limited number of qualified employees who are given a unique password to gain access to the information. We audit our security systems and processes on a regular basis. Sensitive information, such as credit card numbers or social security numbers, are protected by encryption protocols, in place to protect information sent over the Internet. While we take commercially reasonable measures to maintain a secure web site – electronic communications and databases are subject to errors, tampering and break-ins, and we cannot guarantee or warrant that such events will not take place.

AcquireUp will not be liable to Visitors or Authorized Customers for any such occurrences. Any transmission of PII is at your own risk.

How can Visitors correct any inaccuracies in PII?

Visitors and Authorized Customers may contact us to update PII about them or to correct any inaccuracies by emailing us at privacy@acquireup.com.

Can a Visitor delete or deactivate PII collected by the Site?

We provide Visitors and Authorized Customers with a mechanism to delete/deactivate PII from the Site's database by contacting privacy@acquireup.com. However, because of backups and records of deletions, it may be impossible to delete a Visitor's entry without retaining some residual information. An individual who requests to have PII deactivated will have this information functionally deleted, and we will not sell, transfer, or use PII relating to that individual in any way moving forward.

Additional Rights Related to Your PII

Opt-out - You may opt-out of future email communications by following the unsubscribe links in our emails. You may also notify us at privacy@acquireup.com to be removed from our mailing list.

Access - You may access the PII we have about you by submitting a request to privacy@acquireup.com.

Amend - You may contact us at privacy@acquireup.com to amend or update your PII.

Please note that we may need to retain certain information for recordkeeping purposes or to complete transactions, or when required by law.

Sensitive PII

At no time should you submit sensitive personal information to the Site. This includes your social security number, information regarding race or ethnic origin, political opinions, religious beliefs, health information, criminal background, or trade union memberships. If you elect to submit such information to us, it will be subject to this Privacy Policy.

Your Individual Privacy Rights

Some jurisdictions (state, federal, national and international), such as California (through various laws, including the California Consumer Protection Act ("CCPA"), Canada, and the European Economic Area (through the General Data Protection Regulation ("GDPR")), provide individuals with certain rights regarding their personal data. Changes to Our Privacy Policy

We reserve the right to modify or supplement this Privacy Policy statement at any time. It is our policy to post any changes we make to our Privacy Policy on this page. We will let our Visitors and Authorized Customers know about changes to our Privacy Policy by posting such changes on the Site. However, if we are changing our Privacy Policy in a manner that might cause disclosure of Personally Identifiable Information that a Visitor or Authorized Customer has previously requested not be disclosed, we will contact such Visitor or Authorized Customer to allow such Visitor or Authorized Customer to prevent such disclosure. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Site and this Privacy Policy to check for any changes.
